Matchmaking Service
DesignMediators will seek prospective Clients for the Designers through online and offline marketing efforts for both Royalty Based Agreements and One-Time Payment based sales. Extensive research will be made in order to find a customer for each particular design. Meetings will be held and presentations will be made if necessary. DesignMediators will bring the Client and Designer through the online platform, communicating the design details to the Client and Clients’ details to the Designer. Approved and authorized Clients will be able to discover design details, and decide in advance whether a design would fit their existing product portfolio and technology platforms or not.
Negotiation Service
DesignMediators will help the negotiation process between the Designer and Client in order to form a dialogue between them, intended to reach an understanding, resolve point of difference, and to produce an agreement upon courses of actions. Furthermore, DesignMediators, if available, will provide anonymous statistics information regarding the design prices and royalty percentages to respective Clients and Designers, which could be used to form a basis for making an agreement.
Arbitration Service
DesignMediators will provide arbitration to the disputes between the Client and the Designer. This is handy especially when the subject matter of the dispute is highly technical, arbitration is often faster than litigation in court. Arbitration can be cheaper and more flexible for parties than litigation in court. Furthermore arbitral proceedings and an arbitral award are generally non-public and can be made confidential which will let the parties to keep their prestige avoiding legal issues after any dispute. In addition, in arbitral proceedings the language of arbitration may be chosen, whereas in judicial proceedings the official language of the country of the competent court will be automatically applied.
Conciliation Service
DesignMediatiors will also provide conciliation to the Client and the Designer by providing them a conciliator, who then meets with the parties separately in an attempt to resolve their differences and in order to arrive at a solution. This is done by lowering tensions, improving communications, interpreting issues, providing technical assistance, exploring potential solutions and bringing about a negotiated settlement.
Technical Support
DesignMediators possess expert knowledge of the design domain in which they conciliate, both the Designer and the Client will receive suggestions for agreement or settlement terms and will get advice on the subject-matters. DesignMediators can also help the Client and the Designer to find a way to realize the design by providing additional support and service. Furthermore, DesignMediators will provide a base agreement that could be used by the Designers and the Client for transferring design rights from the Designer to Client. This base agreement is written in an impartial, natural way that seeks to balance the interests of both parties on equal levels.
Confidentiality
DesignMediators will provide confidential service with four levels of opacity. 1. The mediation meetings will be conducted behind closed doors. 2. Outsiders can only observe proceedings with both parties consent. 3. No recording of the transcript is kept; and 4. There is no external publicity on what transpired at the mediation. The confidentiality aspect is especially useful for the involved parties, particularly when disputes arise in sensitive areas of operation and to avoid their affairs becoming publicized among business competitors, acquaintances or friends.
